Guy wins ebay auction for Lancer EVO8, and dealer won't sell

You know what would be really funny? Cruise the lot at Marks, write down a bunch of VIN's, Setup a new user as Mark Mitsubishi (very similar name, no "s"), list them with starting bids of $10K just like the Evo, lift picture of Marks sign from the Evo listing, and let the bidding begin.

Those of you who said that what Marks did was not a crime, should note that by the same logic, this is not a crime.

Payback's a b1tch.

I just think the dealership didn't take eBay as seriously as it should. And maybe the guy was telling the truth...maybe he was just too busy to cancel the auction. Sure you have a responsibility with eBay but it is very legitimate if he was not able to cancel the auction in time. He might have sold the car at the higher price an hour before the auction was over and his Internet connection could have been messed up or something, so he would not have the chance to cancel the auction.
It really sucks for that guy and I feel for him, but there is no easy way to get justice here. He should just give the seller negative feedback and move on to the next STi or EVO.

Considering the exact same car was still listed as available (just at $39000) on the dealer's website long after the auction ended, I think the dealer was just lying about having sold the car already. Because the dealer blatantly lied, I think that justifies pranksters going buck wild on them.

All the support that we, as the internet community, gave, twisted the dealers arm to giving up. Stinks how they (the dealer) make it look like they did MarkD a favor by rejecting the other higher bid. (what other bid)

This is yet more proof the MMC NA sucks.

There are many stories about how the new Evo's motors fail on a 100% stock, all mantanince done at the dealer and MMC denies the warrenty claim[mad]

I love my VR-4 and i want a Starion but i will never buy a new still under warrenty Mitsu

I thought the sticker price of the EVO is like $32K.
I can't believe this guy weasled his way into a brand-new EVO for $8K off base MSRP. Business is business, and if I was the dealership, I would have told him to go away.

It's got like two tone interior, dvd player, screens in the headrests, etc. The price on the dealer's website was listed at $39,000 and it never was taken off or noted that it was sold like the dealer claimed. Considering the deluge of calls to that dealership and all the calls to Mitsu North America and bad press on the internet, I guess the dealer figured it try and cut its losses and try and salvage what's left of its reputation. Pretty much everyone is sure they would have lost in court. From what I learned of contract law, the dealer would almost certainly have lost. I'd like to hear Brahtw8's take on it, but I couldn't really see anything in favor of the dealer other than the argument that deal was unconscionable. But, it was an auction without reserve so I don't see that argument as a winner.

Final update from MarkD, posted a week ago, here is the news:

This experience has been memorable for me.

With input from my family and friends, I reversed my decision to buy the ebay Evo. I simply decided I might be happier with this completely behind me. I informed the dealer of my decision two days after my acceptance. I have no doubt that if the dealer had honored the auction without delay, I would have bought the ebay car and been happy. Although the details of the dealer's latest offer appear similar to the terms of the ebay auction, the deal does not feel exactly the same to me. The damage to trust is too great IMO to take a $26k gamble.

Some think the auction was a once in a lifetime deal; some do not. If you value the custom interior, the deal was attractive. I would have to spend $154 total for a flight to AZ, around $90 in gas, and a few bucks in cab, motel, and misc expenses. I estimated my out of pocket expenses would be about $350 on the high side. Mileage wasn't a big concern since I don't put many miles on my car. Wear and tear was a consideration to me. A few weeks/months ago the best price I was able to negotiate was $27,500 for a red $30,812 Evo with a moonroof in my hometown. Prior to the $26.2K auction, at least one individual reported a $27k sale for an Evo with a moonroof. The buyer did not think that same deal was readily available. I have not checked recent prices.

More Details? There aren't that many details. I think I revealed most details already.

New details! -- Several weeks ago I registered my credit card with ebay. This is necessary to place large bids on ebay. Recently I misplaced my credit card and canceled it as a precaution. I didn't think of this prior to placing my bid on the ebay Evo. I placed my bid about 5 minutes before the auction ended. My initial bid on the red Evo did not go through. At first I did not know why. I remember that I cancelled my old credit card. I thought this could be why my bid did not go through. I ran to get my new credit card with less than 5 minutes to go, registered the new credit card, bid again on the red Evo with almost no time left, clicked place bid button, the screen went blank for a fraction of a second, and came back declaring that I was the high bidder. Whew!

I wanted the ebay car before the auction and after the auction. I even reserved a flight to AZ. This experience hasn't been exactly pleasurable for me, so please forgive me for wanting to forget about it for a while and not posting.

After a public battle with emotional highs and lows, Jerry Springer closes with a few elegant words . I don't have something equally poignant, but something was achieved here -- we demonstrated that we want the world to be better than it is -- we want everyone to play by the rules. I admitted I could be silly. I would like to thank all the participants who were on my side -- I believe my latest actions fall outside the rules covering the auction -- I hope I have not alienated you with my decision.

I have a profound respect for the power of the electronic community. I do not plan to post again on this particular topic. Thanks again.
